The law and private individuals

Private law concerns the law between individuals, and can be distinguished from public law which involves the state. The law of tort, the law of contract, unjust enrichment and the law of property could be considered typical private law topics.

It is usual for one law firm to cover a wide range of private law issues, particularly if the firm is not based in a city. Some types of contract or arrangement are straightforward and most solicitors will undertake some of this work. An example of this could be preparing a will - almost any high street solicitor will have someone in the firm proficient in this area of law. In the event that you require anything out of the ordinary, for example if you have a large amount of money and want to know about business investments that will allow your beneficiaries to pay less inheritance tax, then you should contact a solicitor who specialises in this type of work.

Private law is essentially concerned with the correct action occurring. In contract law, the correct action is to attempt to put the claimant in the position they would have been in had the defendant gone through with the contract as agreed. In tort law, the correct action is to attempt to put the claimant in the position that they would have been in had the tort never happened. The most common way of doing this is to compensate the claimant financially, though there are other remedies available.
