The conveyancing process

It is usual, when buying or selling your home, to instruct a conveyancer. This is a specialist legal practitioner who deals with all the legal aspects of the sale, for example title searches, filing documents at the land registry and dealing with stamp duty land tax. This conveyancing process can often be time consuming and complicated as there are a multitude of tasks to do, all within certain periods of time. Conveyancing solicitors can help with the whole process.

Whilst many people opt to instruct specialist conveyancers, there are some who take on the conveyancing process themselves. Brave though they may be, this is often a dangerous thing to do as mistakes can cause costly delays and could result in the collapse of the sale, for example if tasks are not completed on time. Conveyancing solicitors, on the other hand, have in-depth experience and often years of knowledge in property law. They also keep up-to-date with all the changes in the law and can advise you on the best route to take to get the desired effect in a cost-effective manner.

The conveyancing process usually begins with the property solicitor taking instructions. They will carry out certain searches, such as the local authority searches for the property, Land Registry searches and investigating title. Typically, the conveyancer will arrange a structural survey before creating the contracts of sale and exchanging these with the solicitor from the other side. The conveyance will deal with all documentation up to completion, including financial arrangements with mortgage lenders. If the buyer is obtaining a mortgage from a regular bank or building society, the conveyance or property lawyer can usually act for both parties.

There are many steps on the conveyancing process, all of which demand a lot of attention to detail and knowledge of the procedure. Taking on such a task is risky and should really be left in the hands of a professional. Local conveyancers are available throughout the UK and provide comprehensive, professional services to home-buyers and sellers.
