Flight accident claims

If you have been injured on a flight, or whilst getting off or on to an aircraft, you may be entitled to claim compensation. Common accidents that occur on aeroplanes include burns or scalding caused by the spillage of hot drinks, injuries sustained in a crash or collision, and injuries resulting from luggage falling out of overhead lockers.

Establishing whether or not you have a compensation claim for an injury sustained in a flight accident is complicated, and a professional solicitor should be contacted in order to help you make a successful claim. The type of claim you can make will depend on whether you were injured on a domestic flight or an international flight. Injuries sustained during a domestic flight accident will require a personal injury compensation claim to be made against the airline. A personal injury claim must prove that the injury occurred as a result of the airline’s negligence.

International flights will be covered by the Montreal Convention. The Montreal Convention is the international law governing the carriage of passengers on international flights. If you are injured on an international flight, the Montreal Convention imposes strict liability upon the airline involved. Strict liability means that as long as you can prove the injury or death occurred whilst onboard the aircraft, or getting off or onto the aircraft, there is no requirement to prove that it was the fault of the airline. This contrasts with personal injury claims where fault or causation must be found in order for the claim to succeed. A passenger or bereaved family member has two years to bring a compensation claim under the Montreal Convention.
