Five FAQs on adoption
Can anyone adopt a child?
Yes, as anti-discrimination laws have made it illegal to discriminate against anyone that could give a child a secure home. It is also a common mistake to think that single people can’t adopt. Single people, regardless of their sexual orientation, can apply to adopt a child. If you are unsure if your own personal circumstances make you a suitable candidate for becoming an adoptive parent, a family law solicitor will be able to advise you.
What is the first step in the adoption process?
A chain of adoption agencies handle all adoption applications. You should initially contact the adoption agency local to you. You will be sent an adoption pack that outlines in detail how the adoption process works. In addition, you will be asked to attend an informal meeting about your intentions to adopt. If you have any legal queries about the adoption process, a family solicitor can help.
Does my nationality have an impact on my ability to adopt?
Adoption law states that at least one of member of the couple looking to adopt must be a UK citizen, or have lived in the UK for at least one year prior to the formal application to adopt. If you’re unsure of your status as a UK citizen, contact a family solicitor for advice.
Is parental responsibility the same as adoption?
Parental responsibility is the legal term for the rights and obligations a parent has for their child under the law. When a person or couple adopts a child, they are granted parental responsibility for that child. This means they have the legal right to make important decisions on behalf of the child, such as decisions regarding health care, education and religious upbringing.
How can a solicitor help with my adoption?
Adopting a child can often be quite a complex process. For example, if a couple puts their child up for adoption, they could change their mind at any time during the adoption process, or your own personal circumstances could impact on your ability to adopt. In all these cases, the help of a family law solicitor will be invaluable.
