Drink-driving accidents


One of the major contributors to accidents on our roads is drink driving. Drink-driving accidents often result in serious personal injury and damage to property.

As a consequence, the law treats this seriously, and drink-driving accidents can have serious legal consequences for the driver. If you have been involved in an accident you may wish to seek legal advice.

Drink-driving criminal offences

The main offences which you may be charged for are:

  • Driving (or in charge) when under the influence of drink or drugs
  • Driving (or in charge/attempting to drive) with excess alcohol

A minimum of 12 months’ disqualification applies and penalties of up to a £5,000 fine and/or up to six months’ imprisonment can also be imposed. You will also receive a criminal record. We have more information on our drink-driving information page.

There are also offences relating to failure to submit to breath tests. If you are involved in an accident, the police can require you to submit to one.

If personal injury or damage to property resulted from a drink-driving accident in which you are also being charged for a drink-driving offence, this may affect insurance and any claim for compensation.

Personal injury claims

Driving accidents which involve another driver's negligence are potentially strong cases for claim for loss and personal injury.

If you are a passenger injured in an accident, or an innocent driver and the accident happened in the last three years, then you probably have a case for compensation. This would be from either the driver of the car you were travelling in or the driver of the other vehicle involved in the accident.

Pedestrians also have very strong cases and are almost always entitled to compensation in driving accidents. Even if you are hit by an uninsured driver you may still get compensation from the Motor Insurers Bureau, which has set up a fund to help victims of uninsured drivers.

Driving accidents caused by an intoxicated driver also gives the victim the right to claim compensation for their injuries and other damages from the drunken driver.

Driving while under the influence of drugs or alcohol is illegal and dangerous for a number of reasons. Driving skills are greatly diminished through impaired vision, slower reaction time, numbed brain and a reduced ability to make sound judgments.
