If you are arrested by the police and taken into custody, you have a right to legal advice and should immediately instruct a criminal defence solicitor. Your criminal defence solicitor should advise you on the law relating to your arrest and on the procedure that will take place in the police station. Your solicitor will advise you on the best way to deal with police questioning and will be present during any interview you have with the police. Following investigation by the police, if you are charged with an offence your criminal defence solicitor will represent you in proceedings in the magistrates’ court and, if necessary, the Crown Court. It is usual for a solicitor to instruct counsel to perform advocacy at Crown Court level, though some solicitors will perform the advocacy themselves.

Throughout your case, legal representation is important. At the police station, there is a chance that the police may take more liberties during the interview if a solicitor isn’t present. You will also need assistance from a solicitor when gathering evidence to defend your case and deciding which course of action to take, both at the police station and at court. The solicitor’s role at the magistrates’ court and the Crown Court is very significant and in many cases tactical decisions will need to be made. In addition to the above, few people will be able to perform advocacy to the requisite level of proficiency for either court and assistance from a professional will be required.
