Civil litigation and disputes

By Juan Palomino

Nowadays it is common to contract services or buy products as part of our daily activities, but we do not always receive what we were expecting. If you find yourself in such a situation, you could claim your money back and perhaps get compensation.

As a first step, I always suggest my clients to get in touch with a solicitor. They know the procedures and policies relating to disputes and, most importantly, they can provide the right guidance. Moreover, I always inform my clients that there will be different options available to them, such as:

  • Small claims court

As a first option, if your case worth less than £5,000 then you can go via the small claims court. Although you are allowed to represent yourself, expert legal advice is likely to make a big difference in relation to getting the desired outcome. For many people this is the most straightforward process to claim money back. However, the small claims court process can be long and complicated for a non-professional, particularly if you are involved in a difficult case.

  • Civil litigation

However, if a client is involved in a dispute with a company rather than a private individual then it might be more suitable for them to get in touch with a civil litigation solicitor. Our solicitors can deal with matters such as lending and borrowing money or personal injuries as long it does not include criminal matters. When I get clients on the phone, I always mention the importance of an expert solicitor an expert in those matters. Particularly, when you instruct a solicitor; they are in position to avoid any long-term process or even better; they can solve the case before start it with a pre-action letter.

  • Commercial specialist solicitor

If the dispute is between two or more companies then I have to stress to the client that the legal advice of a specialist solicitor is key, not only for their legal expertise but also from a long-term financial point of view.

Juan Palomino is one of Caven’s most knowledgeable case handlers with extensive experience in this matter from dealing with clients on a day-to-day basis.
