Accidents involving cars

Whilst everyday in the UK there are many different types of accident, cars and other vehicle road accidents are one of the most frequently occurring. Cars combined with speed, inexperience and irresponsible behaviour make a high risk for an accident. Cars can cause serious injury and disability.

If you are involved in a car accident, and property damage or personal injury occurs as a result, there may be legal and financial consequences.

Legally, if you were driving dangerously or inconsiderately, or if you were speeding or driving under the influence of drugs or alcohol, you may be criminally liable. Similarly, if you were driving whilst unlicensed or whilst your licence was suspended, you may be charged for an offence. The police may give you a notice requiring you to attend court before a magistrate, who will consider the circumstances of the offence in deciding what punishment to award you. This can include fines, license suspension, and in serious situations, imprisonment. Some offences, such as drink driving, also leave you with a criminal record.

Financially, you may have to pay for the cost of fixing the damage to the other road user’s vehicle, and to your own. You will need to check with your insurance policy and insurance company whether you are covered. If not, you will have to pay the damages yourself. Whether you are liable to pay compensation depends upon whose fault the accident was. Often, fault is very clear and easily established. In other circumstances, you may need a solicitor or investigator to consider the circumstances of the accident, the probabilities of certain factors having an influence, and to reach a conclusion on whose fault the accident was, with legal and financial liability following.

Naturally, if you were on the receiving end of the accident, and the above points related to the car driver involved, then they would have to go through the processes mentioned. There is a chance that you would be eligible for a compensation claim.
